ELGIBILITY

If you access the Services on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

MODIFICATIONS TO THESE TERMS

We reserve the right to modify, update, replace, or revise these Terms at any time in our sole discretion. Changes become effective immediately upon publication unless otherwise stated. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

ABOUT OUR CONTENT

Narco Attorney produces educational and informational media relating to legal topics, criminal justice, current events, public policy, investigations, news analysis, and related subjects. Content may include legal commentary, interviews, editorial opinions, investigative reporting, news analysis, educational discussions, historical information, entertainment programming, documentary-style productions, viewer questions, public records analysis, court-filing discussions, and case commentary.

The information provided is intended solely for general educational and informational purposes. Nothing published by Narco Attorney should be interpreted as legal advice, legal representation, or professional services.

NO LEGAL ADVICE

THE INFORMATION PROVIDED THROUGH OUR SERVICES IS NOT LEGAL ADVICE. Although licensed legal professionals are associated with Narco Attorney and may discuss legal issues, the information presented is intended solely for educational, informational, journalistic, editorial, or entertainment purposes.

NO ATTORNEY-CLIENT RELATIONSHIP

Viewing our website, listening to our podcast, subscribing to our newsletter, watching our videos, attending our events, following our social media accounts, commenting on our content, emailing us, or communicating with Narco Attorney does not create an attorney-client relationship.

An attorney-client relationship exists only when: both parties have expressly agreed in writing to establish such a relationship; any required conflict checks have been completed; a written engagement agreement has been executed; and all required conditions for representation have been satisfied. Until those steps have occurred, no attorney-client relationship exists.

The attorney associated with the Narco Attorney brand practices law in her individual professional capacity through a separate law firm, which has its own engagement terms, fee agreements, and professional obligations. Narco Attorney LLC is a media and merchandise company. It is not a law firm, and the existence of the Narco Attorney brand does not create, extend, or modify any attorney-client relationship arising from that separate law practice.

DO NOT SEND CONFIDENTIAL INFORMATION

Unless you have entered into a written attorney-client engagement agreement with the separate law firm referenced above, you should not send us confidential, privileged, sensitive, or proprietary information. Communications submitted through contact forms, email, social media, direct messages, voice messages, text messages, comment sections, or online forms may not be confidential and may not be protected by the attorney-client privilege. Submission of information alone does not obligate Narco Attorney to review, respond to, or represent you.

EDITORIAL INDEPENDENCE

Narco Attorney is an independent media organization. Opinions expressed by our hosts, contributors, guests, interviewees, or commentators are their own and do not necessarily reflect the opinions of Narco Attorney LLC, its owners, employees, affiliates, sponsors, advertisers, or partners. Guest appearances do not constitute endorsements. Publication of any content does not imply agreement with every statement made by a guest or contributor. We reserve full editorial discretion over all published content.

CONTENT MAY CHANGE

Legal developments occur frequently. Court decisions are appealed, statutes are amended, and government policies evolve. Accordingly, information presented through our Services may become outdated. Narco Attorney has no obligation to update previously published content. Users are responsible for confirming the current state of the law before relying on any information.

YOUR RESPONSIBILITY

You are solely responsible for your use of the Services, and for any decisions you make based on information obtained through them. You agree that any actions you take in reliance on our content are undertaken at your own risk. Narco Attorney LLC shall not be responsible for decisions made by users based upon educational, editorial, or informational content published through our Services.

INTELLECTUAL PROPERTY, USER CONTENT & COMMUNITY STANDARDS


INTELLECTUAL PROPERTY

Unless otherwise indicated, all content made available through the Services—including but not limited to text, articles, blog posts, podcasts, audio recordings, video content, livestreams, graphics, logos, trademarks, service marks, photographs, illustrations, artwork, animations, designs, page layouts, software, source code, user interfaces, downloads, course materials, transcripts, captions, newsletters, digital products, and all other original works (collectively, the “Content”)—is owned by or licensed to Narco Attorney LLC and is protected by applicable United States and international intellectual property laws. Nothing contained within the Services transfers any ownership rights to you. All rights not expressly granted are reserved.

LIMITED LICENSE

Subject to your compliance with these Terms, Narco Attorney grants you a limited, non-exclusive, non-transferable, revocable license to: access the Services for your personal, non-commercial use; stream podcast and video content; share publicly available content using platform-provided sharing tools; and print or download individual pages for personal reference only.

This license does not permit you to: sell our content; republish our articles; copy podcast episodes; re-upload videos; create derivative works; translate content for redistribution; build commercial products using our content; train artificial intelligence models using our content; use our content in machine-learning datasets; or create competing media products using our Content.

Any rights not expressly granted remain the exclusive property of Narco Attorney LLC or its licensors, including Rebecca Castaneda with respect to the NARCO ATTORNEY marks.

TRADEMARKS

“The Narco Attorney,” “Narco Attorney,” the Narco Attorney logo, slogans, branding elements, graphics, and all associated names, marks, trade dress, logos, and visual identities are trademarks or service marks. The NARCO ATTORNEY name and mark are owned by Rebecca Castaneda (U.S. Trademark Application Serial No. 97202148, International Classes 025 and 041) and are used by Narco Attorney LLC under license. All other marks associated with the Services are owned by Narco Attorney LLC or its licensors.

You may not use our trademarks:

  • in advertising;
  • in domain names;
  • in social media usernames;
  • in paid advertisements;
  • to imply endorsement;
  • in any confusingly similar manner; or
  • in connection with competing products or services,

without our prior written permission.

COPYRIGHT

All original Content published through the Services is protected by copyright law. Except where expressly permitted by law or by written authorization, you may not copy, reproduce, distribute, republish, publicly display, publicly perform, modify, archive, license, sell, rent, retransmit, or otherwise exploit any portion of our Content.

FAIR USE

Narco Attorney may reference, display, quote, or discuss third-party materials—including news articles, court filings, public records, photographs, video clips, audio recordings, and social media posts—for purposes including news reporting, commentary, criticism, education, research, parody, public-interest discussion, and other purposes recognized under applicable copyright laws. Nothing in these Terms limits any rights provided under applicable fair-use doctrines.

USER SUBMISSIONS

Unless prohibited by law, you grant Narco Attorney LLC a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to reproduce, publish, edit, translate, distribute, display, broadcast, perform, archive, adapt, create derivative works from, and otherwise use your User Content in any media now known or later developed. This includes use for podcasts, YouTube, documentaries, books, newsletters, social media, advertising, educational materials, promotional campaigns, and future media projects. You understand that no compensation is owed unless otherwise agreed in writing.

LICENSE TO USER CONTENT

Unless prohibited by law, you grant Narco Attorney LLC a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to reproduce, publish, edit, translate, distribute, display, broadcast, perform, archive, adapt, create derivative works from, and otherwise use your User Content in any media now known or later developed. This includes use for podcasts, YouTube, documentaries, books, newsletters, social media, advertising, educational materials, promotional campaigns, and future media projects. You understand that no compensation is owed unless otherwise agreed in writing.

UNSOLICITED IDEAS

Narco Attorney does not accept unsolicited television concepts, podcast ideas, documentaries, scripts, books, treatments, business proposals, production concepts, or other creative submissions. If you nevertheless submit such materials, you agree that: they will not be considered confidential; no fiduciary relationship is created; Narco Attorney has no obligation to review the submission; and Narco Attorney may independently develop similar ideas without liability.

AI, DEEPFAKES & SYNTHETIC MEDIA

You may not use any portion of our Services, Content, likenesses, voices, images, videos, trademarks, or branding to create deepfakes; generate AI voice clones; create synthetic media; impersonate Narco Attorney personnel; produce misleading media; create AI-generated legal advice attributed to Narco Attorney; or train artificial-intelligence systems without our prior written consent. Unauthorized AI training, scraping, voice cloning, or synthetic reproduction of our Content is expressly prohibited. We reserve all rights available under applicable intellectual property, privacy, publicity, and unfair-competition laws.

SCRAPING & AUTOMATED ACCESS

You agree not to scrape, crawl, harvest, mirror, data-mine, spider, index, use automated bots, use automated scripts, or otherwise extract data from the Services without our prior written authorization. This prohibition includes automated collection for AI training datasets.

COMMUNITY STANDARDS

Users may not post, upload, transmit, or distribute content that: violates any law; promotes criminal conduct; contains threats or harassment; contains hate speech; contains defamatory material; invades another person’s privacy; impersonates another person; promotes illegal drug trafficking or other criminal enterprises; encourages violence; contains malware or malicious code; contains spam or deceptive advertising; or otherwise interferes with the safe operation of the Services. Narco Attorney reserves the right to remove any content, suspend accounts, restrict participation, or report unlawful conduct to law enforcement where appropriate.

SOCIAL MEDIA

Our social media channels are extensions of the Services. We reserve the right to moderate comments, remove posts, limit participation, block users, disable comments, and report abusive conduct. Comments made by users reflect the opinions of those users alone. They do not represent Narco Attorney LLC.

DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

Narco Attorney respects the intellectual property rights of others. If you believe copyrighted material has been used improperly on the Services, you may submit a written DMCA notice containing the information required under 17 U.S.C. § 512. Valid notices should be sent to our designated Copyright Agent at:

We reserve the right to remove allegedly infringing material, suspend repeat infringers, and comply with applicable copyright laws.

ENFORCEMENT

Violation of these Terms may result in removal of content; suspension or termination of access; legal action; injunctive relief; recovery of damages; recovery of attorneys’ fees where permitted by law; and referral to law enforcement authorities where appropriate. Narco Attorney reserves all legal and equitable remedies available under applicable law.

GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Except for Disputes subject to arbitration under the section below, and subject to that section’s exceptions, you agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction and venue of those courts.

DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS-ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Agreement to Arbitrate. You and Narco Attorney LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Narco Attorney LLC (a “Dispute”) will be resolved by binding, individual arbitration, rather than in court, except as expressly provided in this section. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).

Informal Resolution First. Before initiating arbitration, you agree to first contact us at support@narcoattorneymedia.com and provide a brief written description of the Dispute and your contact information. The parties will attempt in good faith to resolve the Dispute informally for at least thirty (30) days before either party may commence arbitration.

Arbitration Rules and Forum. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, as modified by these Terms. The AAA Rules are available at www.adr.org. The arbitration will be conducted by a single neutral arbitrator. Unless you and Narco Attorney LLC agree otherwise, any in-person hearing will take place in Hillsborough County, Florida; however, you may elect to participate by telephone or video conference, or the arbitrator may conduct the arbitration by written submissions, telephone, or video where permitted by the AAA Rules. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Arbitration Costs. Payment of all filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules.

CLASS-ACTION WAIVER. YOU AND NARCO ATTORNEY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

Waiver of Jury Trial. To the fullest extent permitted by law, you and Narco Attorney LLC each waive any right to a trial by jury in any Dispute.

Exceptions. Notwithstanding the foregoing, (a) either party may bring an individual action in small-claims court for Disputes within that court’s jurisdiction; and (b) either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of that party’s intellectual property or other proprietary rights, including the NARCO ATTORNEY marks.

Right to Opt Out. You may opt out of this arbitration agreement within thirty (30) days after first accepting these Terms by sending written notice to support@narcoattorneymedia.com, or to Narco Attorney LLC, 506 North Armenia Avenue, Tampa, FL 33609. The notice must include your name, the email address or account associated with your use of the Services, and a clear statement that you wish to opt out of arbitration. If you opt out, the Governing Law and venue provisions above will govern any Dispute. Opting out has no effect on any other provision of these Terms.

Effect of Class-Action Waiver. If the Class-Action Waiver above is found unenforceable as to a particular Dispute or claim for relief, then that Dispute or claim (and only that Dispute or claim) will be severed from arbitration and brought in the courts identified in the Governing Law section, while all other Disputes remain subject to arbitration. Except as stated in the preceding sentence, if any part of this section is found invalid or unenforceable, the remainder will continue in full force and effect.

Survival. This Dispute Resolution section survives termination of these Terms and your use of the Services.
